In the digital age, photographs are widely shared on social media and online platforms. However, many people are unaware that using someone’s photograph without permission can have legal consequences, especially when it affects privacy, reputation, or personal rights.

Under Indian law, a person has a right to privacy and control over the use of their personal images. Using another person’s photo without consent may violate privacy, particularly if the photo is private in nature or used in an offensive or misleading manner.

If a photo is used for commercial purposes, such as advertising or promotion, consent is generally required. Unauthorised commercial use can lead to claims for damages and injunctions under civil law and intellectual property principles.

Misuse of photographs on social media, including creating fake profiles, morphed images, or defamatory posts, can attract criminal liability under cyber laws and provisions relating to defamation, identity theft, and harassment.

In practice, the consequences depend on how the photo was obtained, how it was used, and what harm was caused. Victims may seek removal of content, file complaints, or approach courts for legal remedies.
