WhatsApp chats are commonly used in daily communication, but many people are unsure whether such messages can be used as evidence in court. Under Indian law, electronic records, including WhatsApp messages, can be admitted as evidence if certain legal conditions are satisfied.
Courts do not automatically accept screenshots of chats as proof. To rely on WhatsApp messages, the party producing them must establish authenticity, meaning the messages are genuine and unaltered. This usually requires compliance with Section 65B of the Indian Evidence Act, which deals with electronic evidence and certification.
WhatsApp chats may be used to support claims in cases involving threats, harassment, agreements, admissions, or disputes. However, courts carefully examine context, sender identity, completeness of chats, and whether messages were manipulated or selectively presented.
Privacy is also a concern. Chats obtained illegally or without proper procedure may be challenged in court. Merely possessing a message does not guarantee its acceptance as evidence; the manner of collection and reliability are equally important.
In practice, WhatsApp chats can be used in court, but only after strict legal scrutiny. They serve as supporting evidence rather than conclusive proof and must be assessed along with other facts and materials.
